TMB’s Data Protection Act Agreement When TMB is engaged by any client to undertake
professional marketing services on behalf of that
client, and there is a requirement for TMB to work
with client data, it is a requirement of the Data
Protection Act 1998 that an agreement exists between
the client (the Data Controller) and TMB (the Data
Processor). This is our agreement:
You, the data controller, engage TMB, the data
processor, to carry out processing on your behalf.
Processing includes enabling you to obtain data
via our code and subsequently storing the data
on your behalf in lists in our system, and providing
you with secure web access to the system for you
to manage and process that data manually, by using
automated functions or by instructing TMB personnel.
We, the data processor, undertake to enable you,
the data controller, to obtain and store data
via our code, and to make the functionality of
that code and access to the system available at
all times. We undertake to see that adequate security
measures are taken here at TMB to prevent unauthorised
access to, disclosure or loss of your data. We
undertake to allow you to securely alter, delete
or retrieve your data at all times. We undertake
to process data in accordance with your instructions.
Responsibility for, ownership of and control
over the data remains with you the data controller
at all times.
